DIDDY: Appeals Court Weighs Challenge to Conviction and 50-Month Sentence

Sean “Diddy” Combs is asking a federal appeals court to overturn his conviction and prison sentence, arguing the judge in his case improperly factored in allegations the jury rejected.

Combs was convicted last July on two counts of interstate prostitution, but acquitted of more serious charges including racketeering conspiracy and sex trafficking. His legal team now claims the judge acted like a “thirteenth juror” by considering alleged abusive conduct when handing down a 50-month sentence.

At sentencing, the judge said Combs had “abused the power and control” he held over women, citing physical, emotional and psychological harm. But prosecutors told the appeals panel that even if there was an error in considering that conduct, it would be “harmless” and the sentence still appropriate.

Combs is serving his sentence at a federal facility in New Jersey and is scheduled for release in 2028. The appeals court has not yet issued a ruling.
